New Hampshire Alcohol Diversion Program Policies

Eligibility

Persons eligible for the program are offenders ages 17–20 arrested for possession/consumption of alcohol - first offense. A “first offender” is anyone who has NOT previously been arrested for an alcohol offense. Subsequent arrests prior to completing court diversion will render the applicant ineligible.

About the Program

The Alcohol Safety Program (ASP) is an educational alternative to appearing in court and is under the direction of the Valley Court Diversion Programs. This is a voluntary option available to all eligible offenders; offenders can choose to take their case to court. Participation in a comparable educational program is not accepted. All offenders will be required to complete an intake meeting and a Gain-Q assessment (substance-abuse screening)

To successfully complete the program and to have the charges dropped, a person must do the following:

  1. pay the court diversion program fee
  2. register with Valley Court Diversion Programs
  3. complete the requirements of the specific program

Scheduled attendance is mandatory. Attendance means arriving on time, participating in the class, and staying until the session ends. An offender who does not register, participate in class or complete the requirements of the program will be considered to have withdrawn from the program. No program fees will be refunded.

The ASP fee must be paid prior to participating in the first session. Failure to pay the fee within a reasonable period of time (to be determined by the Program Coordinator), will result in reinstating the original charges and requiring the offender to appear in court.

ASP classes are usually scheduled once or twice a month depending on the number of referrals. An offender must attend the first available date set by the Program Coordinator. All participants are expected to arrange their schedules if they wish to participate in the ASP class.
